In June, Evolve Bank and Trust’s IT system was hacked and sensitive customer information was stolen. Potential Legal Recourse for Evolve Customers Harmed by Data Breach
Sanford Heisler Sharp McKnight is investigating a class action lawsuit to hold Evolve liable for the data breach and its failure to take reasonable measures to protect consumers from such cybercriminal attacks, as required by law.
In June, Evolve’s IT system was infiltrated by the Russia-based cybercriminal group Lockbit 3.0. While Evolve shut down some of its IT systems shortly after the breach, Lockbit 3.0 was already posting data from the hack the next day, making customers’ PII available for cybercriminals to sell, buy, or exchange on the dark web.
The PII seized in the hack includes customers’ Social Security numbers, birthdates, account information and other personal information. Customers of Evolve’s banking partners – such as Affirm, Airwallex, Bond, Branch, Dave, Visa, EarnIn, and others – may also have been impacted by this security breach.
Financial institutions owe a duty of care that they will use reasonable means to secure and safeguard their customers’ information, prevent its unauthorized access and disclosure, guard it from theft, and detect any attempted or actual breach of its systems.
Our investigation is being led by Kevin Sharp, the Co-Vice Chairman of Sanford Heisler Sharp McKnight and Co-Chair of the firm’s Public Interest Litigation Group. Kevin has nearly 30 years of experience both litigating complex civil matters on behalf of plaintiffs, and as a federal judge, having served on the bench from 2011 to 2017, including three years as Chief Judge, in the U.S. District Court for the Middle District of Tennessee.
