In July 2012, Sanford Heisler Sharp, LLP filed a class action lawsuit against Forest Laboratories, Inc., and Forest Pharmaceuticals, Inc. (“Forest”) on behalf of current and former Forest female sales representatives. The Plaintiffs in the case alleged that i) Forest discriminated against the Class on the basis of their gender with respect to their compensation; (ii) Forest discriminated against the Class on the basis of their gender with respect to promotions; and (iii) Forest discriminated against the Class on the basis of pregnancy, including with respect to their pay and promotions.
After years of extensive litigation, the Parties engaged in settlement negotiations with a nationally known and experienced mediator and ultimately reached an agreement to settle the class action. Pursuant to the settlement agreement, Defendants will pay $4 million to settle the class claims following final Court-approval of the settlement.
On February 1, 2018, the settlement was granted preliminary approval by Judge Ronnie Abrams in the U.S. District Court for the Southern District of New York. On March 2, 2018, notice of the settlement was mailed to the Class. The Court is scheduled to consider whether to grant final approval of the settlement in May 2018.
